Kanchana Rai बनाम Geeta Sharma मामले में माननीय सर्वोच्च न्यायालय ने यह स्पष्ट किया है कि— ➡️ विधवा बहू (Widowed Daughter-in-Law) ➡️ हिंदू दत्तक एवं भरण-पोषण अधिनियम, 1956 के अंतर्गत ➡️ ससुर की संपत्ति (Estate) से भरण-पोषण पाने की हकदार है। 📌 कोर्ट ने माना कि विधवा बहू Dependent की श्रेणी में आती है और उसका दावा कानूनन विचारणीय है। 🔍 यह फैसला पारिवारिक कानून (Family Law) में एक महत्वपूर्ण नज़ीर है, जो विधवा बहुओं के अधिकारों को मजबूत करता है। 👉 कानून सभी के लिए है — जानकारी ही सबसे बड़ी ताकत है।
Supreme Court Guideline | Section 528 BNSS ⚖️
State of U.P. vs. Mohammad Arshad Khan (Criminal Appeal No. 5610/2025, dated 19-12-2025) माननीय Supreme Court ने स्पष्ट किया है कि यदि High Court FIR quash करने से इनकार करती है, तो वह Section 528 BNSS (पूर्व 482 CrPC) के अंतर्गत “No Arrest / No Coercive Action” का संरक्षण नहीं दे सकती। 👉 528 BNSS का उपयोग anticipatory bail के विकल्प के रूप में नहीं किया जा सकता। 👉 गिरफ्तारी से संरक्षण हेतु अलग वैधानिक उपाय (Anticipatory Bail) अपनाना आवश्यक है। कानून की सही प्रक्रिया ही न्याय की आधारशिला है। — Advocate Satish Nath (Legal Awareness | Criminal Law)
